Terms and Conditions of Service and License Agreement

This Terms and Conditions of Service and License Agreement (“Agreement”) outlines the terms under which Aviation Edge provides its aviation data services via API and downloadable databases (the “Services”). By accessing or using any part of the Services, you agree to be bound by this Agreement and our Privacy Policy.

1. Subject of the Agreement

This Agreement applies to your use of the website www.aviation-edge.com (“Website”), all Services offered through it, and all data accessed via Aviation Edge’s APIs and databases. The Agreement is binding upon all registered users (“you,” “your,” “client,” “licensee”). Your use of the Services constitutes acceptance of these terms.

2. Description of service

Aviation Data Services Offered via API and Database Aviation Edge provides: (i) Aviation-related data feeds (both static and dynamic) through APIs, accessible via API keys issued upon subscription. These APIs have usage limitations and may vary based on the selected plan, all of which are detailed on the Website. (ii) Downloadable aviation databases sold as one-time purchases, with static datasets provided “as-is” unless otherwise noted.

3. Account and Registration, and Entity Representation

3.1. By using the Services, you agree to be legally bound by this Agreement. If you disagree with any part of the Agreement, your sole remedy is to discontinue use of the Services.

3.2. You must be of legal age and eligible to enter into contracts in your jurisdiction. If you act on behalf of an entity, you represent and warrant that you are authorized to bind that entity.

3.3. You agree to provide accurate, up-to-date information during registration and keep your account credentials secure. Aviation Edge is not liable for unauthorized access resulting from your failure to protect your credentials.

4. License Scope and Restrictions

4.1. Aviation Edge grants you a limited, revocable, non-exclusive, non-transferable license to use the Services during the subscription term solely in accordance with this Agreement. You acquire no ownership or intellectual property rights in the APIs, databases, or content.

4.2. You may use the data for internal commercial purposes or within your own applications or systems. However, you may not:

Resell, sublicense, lease, lend, or distribute the data or access to the Services;
Scrape, crawl, or build derivative databases using our data;
Share your API key with third parties;
Reverse engineer, attempt to access source code, or replicate the Services;
Misrepresent the data’s origin or remove any proprietary notices;
Use the Services in any manner that violates applicable laws, IP rights, or third-party rights;
Create any API client, service, or product that functions substantially similar to or replicates the Services for third-party use or redistribution.

4.3. You must delete all stored data upon termination of your API subscription. You must also immediately cease all use of Aviation Edge brand names, features, and any communications suggesting continued access.

4.4. Violation of the license terms may result in immediate suspension or termination of access without notice or refund. Aviation Edge may seek damages for any resulting harm.

4.5. Aviation Edge reserves the right to audit usage of the Services, including the volume of API requests and storage behavior, to ensure compliance with this Agreement. Any attempt to circumvent usage limits or conceal actual usage may result in termination.

5. Ownership and IP Rights

All intellectual property and proprietary rights in the APIs, data, website, and all materials provided are owned by Aviation Edge. Your subscription or purchase confers no title or rights to use our trademarks, trade names, or data except as expressly stated herein. Aviation Edge may revoke permission to use its brand features at any time, for any reason.

6. Disclaimer and Limitation of Liability / No Warranties

6.1. Services are provided “as-is” without warranty of any kind. Aviation Edge does not guarantee accuracy, completeness, or continuous availability of data. Service Level Agreement applies.

6.2. Aviation Edge and its suppliers shall not be liable for indirect, incidental, punitive, or consequential damages, including but not limited to loss of profits, revenue, or business opportunities.

6.3. Total liability for any claim shall be limited to the amount paid by the client in the month preceding the claim.

6.4. Aviation Edge is not responsible for errors, delays, or outages caused by factors outside its reasonable control, including third-party services, force majeure, server provider or internet issues.

6.5. We may make changes to the data, APIs, formats, or structures at any time without notice.

7. Unauthorized Use

7.1. Each API key is personal and must not be disclosed. You are responsible for all actions performed using your API key.

7.2. If you become aware of unauthorized use or access, you must inform us immediately. Failure to secure your key or dashboard credentials may result in termination or legal claims.

8. Data Handling and Compliance

8.1. You may only use the Services while your subscription is active. Any storage, use, or transfer of the data after termination is a violation of this Agreement.

8.2. You may not mirror our data to third-party platforms or store it for the purpose of recreating our datasets.

8.3. You must not make claims implying partnership, endorsement, or sponsorship by Aviation Edge without written consent.

8.4. You are solely responsible for compliance with your local tax, import, telecommunications, or regulatory requirements. Aviation Edge disclaims all liability related to your local compliance obligations.

8.5. You represent and warrant that you are not subject to sanctions or export restrictions under EU, U.S., or other applicable laws, and that you will not use the Services in violation of such laws.

9. Pricing, Payments and Refunds

9.1. Prices and API limits are published on the Website. Unused call quotas do not roll over to the next month. Fees are billed automatically at the beginning of each subscription term and stop immediately upon cancelling the API subscription by you on your user dashboard. You may also send us an email for a cancellation request but in this case, it has to be at an earlier date (at least 5 days) than the next renewal date so we have adequate time to carry out your cancellation request manually.

9.2. Upgrades take effect immediately; downgrades or cancellations must be requested at least 5 days before renewal if made via email request directly to us.

9.3. All sales and renewals are final and non-refundable, even if the Services are unused. You accept and agree that the Services start immediately upon your receipt of your API key to your email and therefore, you waive your right to 14-day withdrawal right during signup.

9.4. If payment fails repeatedly, your access may be suspended or canceled. We will not charge you any further or without your knowledge in case your subscription gets canceled due to multiple failed payments.

9.5. Aviation Edge may adjust pricing with prior notice. Continued use constitutes acceptance.

10. Cancellations and Terminations

10.1. You may terminate your subscription anytime via the dashboard or by email request. Termination becomes effective at the end of the current billing cycle. You will still have full access to the Services until the end of your current billing cycle, no matter when you cancel your subscription during the cycle.

10.2. Aviation Edge may suspend or terminate access without notice if you breach the Agreement.

11. Indemnification

You agree to indemnify and hold harmless Aviation Edge, its affiliates, directors, officers, employees, and users from any claims, losses, or liabilities arising from your misuse of the Services, breach of this Agreement, or violation of third-party rights.

12. Applicable Law and Dispute Resolution

This Agreement and any legal dispute that may arise from this Agreement are to be governed by Bulgarian law. All disputes shall be resolved by the courts of Bulgaria. Aviation Edge encourages parties to seek an amicable resolution before initiating formal proceedings.
You agree that no provision of this Agreement shall be interpreted under the laws of any jurisdiction other than Bulgaria, and any mandatory consumer protections under foreign jurisdictions shall not apply.

13. Confidentiality

You must keep all non-public information received from Aviation Edge confidential and use it only for the purpose of this Agreement. Confidentiality obligations survive termination.

14. Changes to the Agreement

We may revise this Agreement periodically. We will notify users of material changes via the Website or user dashboard. Continued use of the Services after changes take effect constitutes acceptance.

15. Miscellaneous

• The Agreement constitutes the entire agreement between the parties.
• If any part is unenforceable, the rest remains in effect.
• Failure to enforce a right is not a waiver of that right.
• The English version prevails over any translations.

16. Relationship of the Parties

The Parties are independent contractors. This Agreement does not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship among the Parties.
